What Does Each ALF Insurance Coverage Mean?

A plain-English guide to the major coverages we discuss with Assisted Living Facility owners in Florida.

Do not buy an ALF insurance policy based only on the premium. Two policies can look similar on price and still provide very different limits, sublimits, deductibles, endorsements and exclusions. The purpose of this page is to help ALF owners understand the major coverages before making a decision.

Simple rule: Pay for the protection your facility actually needs. Understand what you are buying before you renew.

1. Professional Liability

Professional Liability is designed to respond to certain covered claims alleging errors, negligence or omissions connected to professional services and resident care.

Simple example: A resident needs help bathing. The family alleges that proper assistance was not provided, the resident falls and is injured, and a claim is made against the ALF for negligence in care.

2. General Liability

General Liability generally addresses certain covered claims involving bodily injury, property damage and other liability exposures arising from the facility’s general business operations.

Simple example: A resident’s family member visits the ALF, slips on a wet floor and is injured.

Easy way to remember it: Professional Liability relates primarily to care and professional services. General Liability relates primarily to premises and general business-operation exposures.

3. Products / Completed Operations

This coverage is generally part of General Liability and can apply to certain covered claims arising from products supplied or completed operations, depending on the policy wording.

Simple example: Something is supplied or an operation is completed, and it is later alleged that the product or completed activity caused an injury or damage.

4. Personal & Advertising Injury

This coverage addresses certain types of Personal & Advertising Injury specifically defined by the policy.

Simple example: The ALF publishes information and another person or business alleges that the publication caused a covered reputational or similar injury.

5. Fire Damage

Some ALF liability programs include a specific Fire Damage limit for covered claims, subject to the policy terms and conditions.

Important: A Fire Damage limit should not be confused with separate property insurance for the building or business property.

6. Medical Expense

Medical Expense coverage may provide a limited amount for certain covered medical expenses resulting from an injury at the premises, subject to the policy terms.

Simple example: A visitor is injured at the facility and requires medical attention.

7. Sexual Misconduct / Abuse

This is a specialized coverage for certain covered claims involving allegations of abuse or sexual misconduct, subject to the endorsement, exclusions and applicable sublimits.

Simple example: A resident or family member makes an allegation of inappropriate conduct or abuse by a staff member and brings a claim against the facility.

8. Elopement

Elopement coverage can be especially important for an ALF. It addresses certain covered claims involving a resident leaving the facility without the supervision required under the circumstances, subject to the policy terms and sublimits.

Simple example: A resident leaves the ALF without staff realizing it, is injured while away from the facility, and the family alleges inadequate supervision.

9. Wound Care

Wound Care coverage addresses certain covered claims relating to the handling, supervision or documentation of wound care, subject to the policy wording and applicable sublimits.

Simple example: A resident has a wound and the family later alleges that it was not properly handled, monitored or documented and that the condition worsened.

10. HIPAA Carveback

A HIPAA Carveback may provide limited protection for certain covered claims involving HIPAA and the privacy of medical information, depending on the exact policy wording.

Simple example: Medical information intended for one resident’s family is accidentally sent to another resident’s family, resulting in an allegation of improper disclosure.

Important: A HIPAA Carveback is not the same as a full Cyber Insurance policy. Privacy, cyber and HIPAA-related protections must be reviewed according to the actual policy wording.

Limits, Sublimits and Deductibles Matter

Knowing the name of a coverage is not enough. Ask what limit applies, whether there is a separate sublimit, what deductible applies, whether defense costs affect the limit, and what exclusions or endorsements modify the coverage.

For example, an ALF liability program may show different limits for Professional Liability, General Liability, Abuse, Elopement, Wound Care or HIPAA-related protection. Those coverages should be reviewed separately rather than assuming one limit applies to everything.

Can Coverage Be Customized?

Depending on carrier availability, underwriting and the characteristics of the facility, different limits, deductibles and optional coverages may be available. The goal is not automatically to buy every available endorsement or simply choose the lowest premium. The goal is to understand the facility’s exposures and compare the available protection with the cost.

Before You Renew Your ALF Policy

  • Ask what each major coverage means.
  • Confirm the limit and deductible for each coverage.
  • Ask whether important sublimits apply.
  • Review endorsements and exclusions.
  • Compare what you currently have with the new quote.
  • Do not cancel existing coverage until replacement coverage is confirmed.
