Claims-Made vs. Occurrence: What ALF Owners Should Review
Occurrence: the timing of the injury or damage matters. If it took place while that coverage was in force, the policy may respond even if a claim is made later, subject to policy terms.
Claims-made: the timing of the first claim against the ALF matters. Check the retroactive date; depending on the coverage, acts or incidents before that date may be excluded.
When changing policies, a newer retroactive date can create a potential gap for later claims involving earlier events. Ask whether the new insurer will retain the prior date and whether an extended reporting period or tail coverage should be considered when the old policy ends.
A certificate does not tell the whole story. If it says only “claims-made,” that alone does not establish the exact reporting deadline. Read the policy and endorsements and review General Liability and Professional Liability separately.
